Terms & Conditions

By placing an order you accept these terms and conditions. Please read them carefully. To order items through this website you must be at least 18 years of age. We will treat each order for items as an offer by you to purchase the goods subject to these terms and conditions without modification. We reject all proposals to modify or amend these terms and conditions for any transaction. A contract between us only arises upon our acceptance of your order. We have the right to refuse at our discretion to supply any products ordered by you. These terms and conditions do not affect your statutory rights.

Description of goods

All descriptive matter, specifications and advertising are only for the purpose of giving an approximate description of the items. Every effort is made to ensure images give a fair representation of the actual product but 100% accuracy cannot be guaranteed. You undersand and accept that the information listed on our website may change at any time and may contain inaccuracies or incomplete information despite our best efforts.

We try to ensure everything on our website is accurate and up to date. If an item has the wrong description, is unavailable, or is mispriced, we may not accept your order for such item, but may contact you to give notice of any inconsistency of description or price and propose alternative purchase terms.

Whilst we may post links to third-party websites, we make no representations about the accuracy or reliability of the content of any other site. Third-party links on our website do not constitute an endorsement.

Payment method

We accept the following methods of payment:

  • All major Credit Cards except American Express
  • Invoice: UK primary/secondary schools only, payment by BACs or cheque within 30 days of invoice date.

All credit and debit card transactions are subject to validation checks and are authorised by the card issuer. If the issuer of your card refuses to authorise payment to us, we will not be liable for any delay and/or non-delivery of your order.

Payment must be made in Pounds Sterling. If paying from international locations, all monies will be taken in Pounds Sterling and any charges for currency conversion incurred are your responsibility. Your bank or credit card issuer will convert the sterling amount into the local currency of your country using their exchange rate.  We cannot predict or influence the exchange rate they use or any fees they may charge.

Custom duties

Destinations outside the UK may be subject to import duty. These are not included in our prices and are the responsibility of customers to pay on or after receipt of goods.

Availability of goods

All products are subject to availability and any product may be withdrawn at any time.

Pricing

Prices are subject to change without prior notification.

Delivery, Short Delivery & Non-Deliveries

Any delivery date is an estimate only and we expressly disclaim that time is of the essence for any delivery.
Delivery will be made to the address supplied by you.
For security purposes, we do not deliver to P.O. Box numbers.
If delivery can not be made to the address supplied by you, the goods will be returned to our distribution warehouse and any further delivery will incur additional delivery charges.
We may deliver fewer items than those ordered if there are shortages of stock. We will deliver the balance of goods to you when they become available.
Where appropriate, all items must be signed for by the customer upon delivery. If the order is not delivered, we require notification within 45 days from placing the order or receipt of payment. We will use the track and trace service offered by our courier company and a Proof of Delivery notification provided if necessary.  In the case of non-delivery, if the parcel is not recovered, we will either resend the items at no cost to you or offer you a refund.

Shortage

It is your responsibility to check and sign for the correct number of packages as shown on the delivery or carrier consignment note. If you suspect that there are items missing from the delivery, first check that the order has not been partly shipped. Any shortage must be notified to us within 2 working days.
If we are not notified of a shortage other than as a result of part shipment within 2 working days of delivery, then it shall be deemed that full delivery has taken place.

Events beyond our control

We are not responsible for any delay or failure in carrying out our duties under this Agreement if the delay or failure is caused by circumstances beyond our reasonable control. These circumstances include civil commotion, riots, disease outbreak, flood, drought, fire, fault of the postal service or the courier service, strikes, and machine breakdowns.
You must allow us reasonable time to carry out our duties in these circumstances.

Privacy

All personally identifiable information that you provide to us will be kept confidential and only those personnel with a legitimate business purpose will have access to this information. Please see our privacy policy page for comprehensive details.

We do not knowingly collect, maintain or process personal information submitted by or on behalf of children under the age of eighteen (18). Please notify us immediately of any such information you believe may have been provided to us by contacting sales@phonicbooks.co.uk so that it may be properly deleted.

We do not pass on any details to third parties for marketing purposes. If you elect to be added to our emailing list, we will email you occasionally with relevant information. At the foot of each email is an ‘unsubscribe’ button so you can elect to leave our mailing list at any time.
Your private financial data is not stored by us or shared with any third party company.

Financial Data Privacy

We will not store your financial details on our web server or local machines. If ordering via telephone, your transaction will be processed immediately and your financial details will not be stored.
If you pay online, you will be redirected to a secure server and no financial data, logins or passwords are captured by us.

Limitation of Liability

WE DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE WILL NOT BE RESPONSIBLE FOR ANY CONSEQUENTIAL, DIRECT OR INDIRECT COSTS, DAMAGES OR LOSSES OF ANY KIND RESULTING FROM THE USE OF ANY PRODUCT PURCHASED THROUGH THIS WEBSITE. OUR MAXIMUM LIABILITY ON ANY CLAIM SHALL NOT EXCEED THE PRICE YOU PAID FOR OUR GOODS.

Promotional Discount Codes

We may occasionally offer promotional discount codes to registered members. These codes may only be applied to purchases made through the member account to which the discount code was offered.
We may occasionally offer promotional discount codes which can be applied to any, or to certain specified purchases made through the website. Only one promotional discount code can be applied to any one order.
Specific Terms and Conditions may apply to certain codes and these will be specified at the time of issue. Promotional discount codes are not available for use by distributors, bookstores or stockists.

UK and international delivery charges

All our deliveries are sent out using Royal Mail Special Delivery or by selected courier.

VAT

Phonic Books products are currently free of VAT unless otherwise stated.
VAT on postage and delivery charges are quoted inclusive of VAT where necessary.

Governing Law and Jurisdiction

Our agreement with you shall be governed by and construed in accordance with the Laws of England and Wales.
You agree for all purposes to the non-exclusive jurisdiction of the Courts of England and Wales.

Disputes

If we have made a contract with you by electronic means, you may be entitled to use an EU online dispute resolution service to assist with any contractual dispute you may have with us. This service can be found at http://ec.europa.eu/odr. Our email address is info@phonicbooks.co.uk.

Distributors, bookstores and stockists

All our terms and conditions, as described above, are also applicable to distributors, bookstores and stockists.

Giveaway Terms & Conditions – Phonic Books Hidden in Paris Giveaway

  1. The promoter is: Dorling Kindersley Limited (01177822) whose registered office is at One Embassy Gardens, 8 Viaduct Gardens, London, SW11 7BW
  2. The prize draw is open to educators who are residents of Australia aged 18 years or over, excluding employees of the Promoter and their close relatives and anyone otherwise connected with the organisation of the prize draw.
  3. There is no entry fee and no purchase necessary to enter this prize draw.
  4. By entering the prize draw, an entrant is indicating their agreement to be bound by these terms and conditions.
  5. Route to entry is to share a photo with the DSF Language, Literacy and Learning Conference tote bag on Instagram, tag Phonic Books, and use the hashtag #HiddenInParisCompetition.
  6. Only one entry will be accepted per person. Multiple entries from the same person will be disqualified. Persons found to be entering via multiple Instagram accounts will be disqualified. 
  7. Closing date for entry will be 25 March 2024.  After this date, no further entries will be considered.
  8. No responsibility can be accepted for entries not received for whatever reason. 
  9. The promoter reserves the right in exceptional circumstances to cancel or amend the prize draw and these terms and conditions without notice. No correspondence will be entered into.
  10. The promoter is not responsible for inaccurate prize details supplied by any third party connected with this promotion.
  11. A prize draw will take place on 27 March 2024 and 1 winning entry will be chosen at random.
  12. The prize for each winner is one set of Hidden in Paris and one copy of the Hidden in Paris workbook.
  13. The prize is as stated and no cash or alternative will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice. The prize must be delivered to an Australian school address.
  14. Winners will be randomly selected by a third-party selection tool. We will also manually inspect the chosen account. 
  15. The winner may be required to prove eligibility, including, without limitation, proof of age, residence, and identity. 
  16. Winners will be notified by direct message on Instagram within 28 days of the closing date. The winner(s) will only ever be contacted by Phonic Book on Instagram or Phonic Books on Facebook. If the winner(s) cannot be contacted or does not claim the prize within 30 days of notification, it will lapse and the Promoter reserves the right to offer the unclaimed prize to a substitute winner selected in accordance with these rules.
  17. The promoter will notify the winner(s) when and where the prize is delivered.
  18. The promoter’s decision with respect to all matters to do with the prize draw will be final and no correspondence will be entered into. 
  19. We will make the winner’s name and county available on request to the following email address dklearning@dk.com. If you do not want your name and county to be made available in the event that you win, please let us know by emailing dklearning@dk.com. Please note we are required to make the winner’s details available to the ASA if requested.
  20. This competition is in no way sponsored, endorsed or administered by or associated with Instagram. You acknowledge that all information and material that you submit to enter this competition is submitted to the Promoter and not Instagram or Facebook and you agree that Instagram or Facebook shall not be liable to you in any way in respect of this competition. 
  21.   22. The prize draw and these terms and conditions are governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
